Location Service Terms

Effective 1 October 2026

Article 1 (Purpose)

These terms set out the rights, obligations, and responsibilities between HAUTEN (the “Company”) and users regarding the use of personal location information in the stamp tour service STAMPY.

They exist to inform you and obtain your consent before personal location information is used, as required by Article 19 of Korea’s Act on the Protection and Use of Location Information.

Article 2 (Effect and changes)

  1. These terms take effect when posted on the service screen or otherwise notified to users.
  2. The Company may change these terms where necessary, announcing changes on the service screen at least 7 days before they take effect, or 30 days for changes unfavourable to users.
  3. A user who does not agree to the changed terms may withdraw consent.

Article 3 (What the location service does)

The Company uses personal location information to provide the following.

Spot visit check Confirms that you are within the set radius of a stamp spot, fulfilling the visit requirement
Nearby spots Shows the spots closest to you first on the map and in lists

“Nearby spots” is computed entirely on your device; no coordinates are sent to the Company’s servers. The only time the Company receives coordinates is for the spot visit check.

Article 4 (Use and retention of personal location information)

  1. When you attempt a spot visit check, the Company receives your device’s coordinates and uses them solely to compute the distance to the spot.
  2. The Company does not store coordinates. They are discarded immediately after the distance is computed; all that remains is whether the spot’s requirement was met.
  3. Accordingly, the purpose of holding personal location information is the spot visit check, and there is no retention period.

Article 5 (Basis and period for keeping records of use)

  1. Under Article 16(2) of the Act on the Protection and Use of Location Information, the Company automatically records and retains confirmation records of location information use in its location information system.
  2. What is recorded is who (visitor identifier) attempted a location check at which spot, when, and with what result. Coordinates are not included.
  3. Records are kept for 6 months and then destroyed.

Article 6 (Disclosure to third parties)

The Company does not disclose users’ personal location information to third parties. Should disclosure become necessary, the Company will inform you of the recipient and purpose in advance, obtain separate consent, and notify you immediately of the recipient, time, and purpose each time it is disclosed.

Article 7 (Your rights)

You have the following rights, which the Company will not refuse.

When you withdraw consent, the Company destroys the records of use without delay. After withdrawal, spot visits can still be confirmed by the other methods the event offers: QR, NFC card, or staff confirmation.

Article 8 (Protection of children)

  1. Children under 14 cannot agree to these Terms. Article 25 of Korea’s Location Information Act requires the consent of a legal guardian, and its verification, before the personal location information of a child under 14 is used; the Company has no means of verifying a user’s age or guardian. Only people aged 14 or over may therefore consent to location confirmation, and children under 14 confirm their visit to a spot by the other methods the event provides (QR, NFC card, or staff confirmation) instead.
  2. Where a guardian of any of the following (a “child aged 8 or under, etc.”) consents to the use of personal location information to protect that person’s life or body, the Company treats it as the person’s own consent.
    • A child aged 8 or under
    • An adult ward
    • A person with a disability as prescribed by Presidential Decree under the Act on Welfare of Persons with Disabilities
  3. To consent, the guardian must state the consent in writing or similar and submit it to support@stampy.site together with a document proving guardianship.
  4. The guardian may exercise the rights of the child aged 8 or under, etc., on their behalf.

Article 9 (Damages and limitation of liability)

  1. If the Company causes you damage by violating Articles 15 to 26 of the Act on the Protection and Use of Location Information, you may claim compensation. The Company is not exempt unless it proves the absence of intent or negligence.
  2. The Company is not liable for damage caused by events beyond its control, such as natural disasters, carrier outages, or positioning errors on your device.
  3. Satellite positioning (GPS) is inherently subject to error; the Company accounts for this by judging each spot within a set radius.

Article 10 (Dispute resolution)

  1. Disputes about these terms are first resolved by agreement between the Company and the user. Failing that, you may apply for adjudication by the Korea Media and Communications Commission (formerly the Korea Communications Commission) under Article 28 of the Act on the Protection and Use of Location Information, or for mediation by the Personal Information Dispute Mediation Committee.
  2. Other disputes are governed by the laws of the Republic of Korea, with jurisdiction determined by the Civil Procedure Act.
